EXECUTIONS
If the debtor does not intend to fulfill voluntarily, it is necessary to initiate specific or general enforcement. If served with the title, be it a judgment, order or injunction, and/or together with the writ of execution, the debtor fails to fulfill one may proceed to levy of execution, i.e., garnishment.
The choice of the type of garnishment is conditioned by the outcome of the necessary investigations aimed at identifying the assets or liquid assets that can be seized. Enforced expropriation begins with the act of attachment of real estate, movable property or third parties, which is aimed at receivables or more a general assets of the debtor that are at the disposal of the third party.
The function of the attachment is to bind certain assets of the debtor to the satisfaction of the claim of the proceeding creditor and also of all other creditors who may later intervene in the enforcement process.
